It doesn't matter if its legal on the federal level. The states were left to make stricter laws if they wanted to. Some states passed laws specifically allowing it, some (like my own Louisiana till recently) didn't do a thing for or against it, and some like Alabama and Mississippi made it illegal. I see there was a bill (Alabama Senate bill SB153) that they tried to get passed this year, but it got stuck in committee. Thankfully, Louisiana just recently put something on the books definitively making it legal to brew here.

He would still, potentialy, face charges. It would be an "unpopular" prosecution but the jeebs could still seek "justice". Ex Post Facto is the legal term in splaining the legalese.
Distilling and/or brewing, I still have a hard time with the po po and the prosecutor working this.

Hey sheriff, you tard, where are the thousands of pounds of sugar a moonshiner would go through

Here's a tip, go check out the restaurants in town, I bet they have big "cookers" like that too, they must be moonshining
