It doesn't matter if its legal on the federal level. The states were left to make stricter laws if they wanted to. Some states passed laws specifically allowing it, some (like my own Louisiana till recently) didn't do a thing for or against it, and some like Alabama and Mississippi made it illegal. I see there was a bill (Alabama Senate bill SB153) that they tried to get passed this year, but it got stuck in committee. Thankfully, Louisiana just recently put something on the books definitively making it legal to brew here.

Here's a question.....right now, it is illegal to homebrew in Al. What would happen if this guy was charged, but the trial keeps getting put off, and delayed, and by some stroke of luck, Al. passes the homebrew law, would the charges get dropped, or reduced?? Or would they still press on with the trial since at the time of his arrest, it was illegal??? Just wondering out loud.

I'm in the fucked up state next to him, Ms. which has the same laws.....gotta love the bible thumping hypocrites in the south!!!!.

He would still, potentialy, face charges. It would be an "unpopular" prosecution but the jeebs could still seek "justice". Ex Post Facto is the legal term in splaining the legalese.
Distilling and/or brewing, I still have a hard time with the po po and the prosecutor working this.
