The company did their due diligence; the "saved" names are not public information. There was no way for the company to ascertain this information. What you call smart, I call corporate greed and litigious bullying. By the way, the two are not mutually exclusive.

There is a start up brewery in Austin that is in the planning stages. They put up a blog under the name Barbed Wire Brewing Company. They were hit with a cease a desist from a family owned winery in California (Sutter Home), which had plans to use the name Barbed Wire for a wine they were thinking about making. This small startup decided it would be easier to change their name to Twisted X Brewing than to fight a small, family owned winery in another state. So it's not just corporate greed that drives it.

The saved names were public information because they were on display for sale in a few, select outlets. This, according to our division manager, allowed the company to trademark the names.

Sorry, but you referred to JP's post, which quoted mine, so I thought you were referring to what I said. Hence the "saved names" post. The story about Twisted X is related to the "saved names" story I told that JP though was a smart business move, which you found objectionable. I didn't realize you were using JP's comments to me to reply to another case.

As Crow T. Robot said in one episode of MST3K: "Sorry. Sorry, everyone. Only meant to blow up that one thing."
