Gordon Biersch weizen eisbock

Doing some research on the legality of a licensed brewery making eisbock, I wonder how Dan did this. Any thoughts? JZ or Dan?

AFAIK it's not illegal (different state laws may limit %ABV though). Icing is not distilling. Distilling = separation; Icing = concentration.

The info available from the ttb does not sound completely consistent to me, but here is what they say: http://www.ttb.gov/rulings/94-3.htm
